Nothing About Your Situation Has Expired

Criminal inadmissibility is one of the few areas of Canadian immigration where waiting can actually work in your favour. The eligibility thresholds are tied to the passage of time — so the case that wasn’t ready when we last spoke may be ready now.

Criminal Rehabilitation becomes available once five years have passed since you fully completed your sentence — including jail time, fines, probation, and community service. If you were short of that five-year mark when we first reviewed your file, you may have crossed it since.

And if you need to be in Canada before a rehabilitation application could be approved, a Temporary Resident Permit can bridge the gap — typically four to six months, and in some circumstances issued at the border.

One important exception: impaired driving offences committed on or after December 18, 2018 are classified as serious criminality and are never eligible for deemed rehabilitation. In those cases, a formal application is the only route — which is precisely why leaving the file dormant is the costliest option.

That’s exactly what we want to hear, and it’s often good news. Completing a sentence, crossing the five-year threshold, having a charge withdrawn, or a new travel deadline can all change which route is available to you. Note it on the form and we’ll reassess from there.

I need to travel to Canada soon. Is it too late? +

Not necessarily. A Temporary Resident Permit is designed for exactly this situation — it authorises entry while you remain technically inadmissible. Processing is typically four to six months, and in certain circumstances a TRP can be issued at a port of entry. Tell us your travel date on the form so we can advise on what is realistic.
