Outland Spousal Sponsorship Canada

Outland spousal sponsorship allows a Canadian citizen or permanent resident to sponsor their spouse or common-law partner for Canadian permanent residence — regardless of where the sponsored person is currently living.

Although this program was originally designed for applicants living outside Canada, individuals residing in Canada may also apply under the Outland stream.

Outland spousal sponsorship often provides greater flexibility, including the ability to travel in and out of Canada while the application is processing.

Inland vs. Outland Spousal Sponsorship

The primary difference between Inland and Outland spousal sponsorship is where the sponsored person resides during processing.

Inland Sponsorship

Choose Inland sponsorship if:

  • Your spouse or common-law partner is currently living with you in Canada
  • They hold a valid temporary status (visitor, worker, or student) or may qualify under special public policies
  • International travel during processing is unlikely

Inland applications are processed while the applicant remains in Canada. If the applicant leaves Canada and is denied re-entry, the application could be considered abandoned.

Outland Sponsorship

Choose Outland sponsorship if:

  • Your partner lives outside Canada
  • Your partner is living with you in Canada, but wants faster average processing times
  • You want the right to appeal a refusal (Outland applications generally include appeal rights to the Immigration Appeal Division)
  • Your partner expects to travel outside Canada during processing

Work Permit Eligibility

In both the Inland and Outland sponsorship streams, applicants who hold a valid temporary status in Canada may also be eligible to apply for a Spousal Open Work Permit. This status allows them to work while their permanent residence application is in process.

If you are eligible for Inland sponsorship, you are also eligible to apply for Outland sponsorship. In many cases, Outland is strategically preferable as it offers all the same benefits and shorter processing times.

Outland Spousal Sponsorship Requirements

Both the sponsor and the sponsored person must meet eligibility requirements.

Sponsor Requirements

To sponsor a spouse or partner, you must:

  • Be a Canadian citizen or permanent resident (if a citizen living abroad, demonstrate intent to return to Canada once the application is approved)
  • Be at least 18 years old
  • Not have sponsored a spouse within the previous five years
  • Not be in prison, bankrupt, or charged with a serious offence
  • Not under a removal order (if a permanent resident)

Sponsored Person Requirements

The sponsored individual must:

  • Be at least 18 years old
  • Not be a close blood relative of the sponsor
  • Be in a genuine relationship (marriage, common-law, or conjugal partnership)

Unlike Inland sponsorship, the sponsored person does not need to hold a valid temporary status in Canada if they are applying from outside Canada.

Relationship Validity

  • Marriages performed in Canada must be legally valid under Canadian law.
  • Marriages performed abroad must be legally recognized both in the country where they occurred and in Canada.
  • Same-sex marriages must have taken place in a country where same-sex marriage is legally recognized.
  • If a marriage is not legally valid, couples may qualify as common-law or conjugal partners if they can demonstrate proof of a relationship.

Outland Spousal Sponsorship Processing Times

Family reunification remains a top priority in Canada’s immigration system. However, Outland sponsorship, with the exception of Quebec, offers faster processing times on average. 

  • Outland sponsorship: Approximately 15 months
  • Inland sponsorship: Approximately 21 months
  • Quebec applicants (Inland or Outland): Approximately 35 months

  1. Application completeness
  2. Criminal or medical checks
  3. Additional document requests
  4. Quebec’s additional provincial review requirements

Spousal Sponsorship Minimum Necessary Income

For Outland spousal sponsorship, there is no Minimum Necessary Income (MNI) requirement when sponsoring:

  • A spouse
  • A common-law or conjugal partner
  • Dependent children

However, MNI requirements apply when sponsoring parents, grandparents, or certain other dependent relatives.

How Can I Receive an Open Work Permit Under Outland Sponsorship?

In 2023, eligibility rules were expanded to allow certain applicants under the Outland spousal sponsorship stream to apply for an open work permit while their permanent residence application is being processed.

This change provides greater flexibility and financial stability for families throughout the processing period.

Who Is Eligible?

You may be eligible to apply for an open work permit if you are:

  • The spouse, common-law partner, or conjugal partner of a Canadian citizen or permanent resident who is living in Canada; or
  • An accompanying dependent child of a principal applicant being sponsored

To qualify, the applicant must generally:

  • Have submitted a complete spousal sponsorship application
  • Reside in Canada with a valid temporary resident status (or be eligible to restore status, where applicable); and
  • Continue to meet admissibility requirements

An open work permit allows you to work for most employers in Canada without requiring a Labour Market Impact Assessment (LMIA).

Outland Sponsorship in Quebec

If you reside in Quebec, additional requirements apply.

In addition to federal approval, Quebec sponsors must obtain a Certificat de sélection du Québec (CSQ) and sign a provincial financial undertaking for a three-year term.

The sponsored person must:

  • Hold a valid temporary status in Canada
  • Be at least 18 years old
  • Not be closely related to the sponsor

Average processing times for Quebec sponsorship applications are currently 35 months due to the dual federal-provincial review process.
